Regarding the activities with signs of corruption of the Public Health Center of the Ministry of Healthcare of Ukraine, which directly participates in co-operation with the Global Fund
Dear colleagues,
I guess that most of you are not familiar with the events of the end of 2017, which preceded the meeting of the National Council for TB Control in Ukraine on October 5, 2017. Me as well have only recently received information on events that of course in the necessary volume were not shamily announced neither by the State Health Care Center of Ukraine, nor the Ministry of Healthcare of Ukraine in the course of an independent journalistic investigation.
It is a case of actions with frank signs of corruption for the amount of more than 10 million hryvnia in the Center, which are reflected in the internal audit of the activities of the Center.
In the third quarter of 2017, the Ministry of Healthcare of Ukraine conducted an internal audit of the Center's activities. According to the audit results, the AUDITOR'S REPORT was performed on the results of the internal audit of the Public Institution " Public Health Center of the Ministry of Healthcare of Ukraine" No. 13-15 / 06 of September 8, 2017.
This report presents the results of planned internal audit (in terms of financial audits and compliance audits) conducted at the Public Health Center of the Ministry of Healthcare of Ukraine for the period from 1 January 2016 to 1 July 2017.
The audit was conducted in accordance with the Internal Audit Activity Plan of the Ministry of Healthcare of Ukraine for the second half of 2017, approved by the acting Minister of Ukraine from June 12, 2017, according to the order of the Ministry of Healthcare of Ukraine dated July 24, 2017 No. 47-Adm and in accordance with the Procedure for conducting internal audit in the system of the Ministry of Healthcare of Ukraine, approved by the Order of the Ministry of Health of Ukraine dated March 27, 2012 No. 207.
It is the very auditor's report that clarified the activities of the Center as such that there are signs of corruption.
We must pay tribute to a courageous and honest act of the Acting Minister for Public and Principle Fighting Corruption in the Departments of the Ministry. How Mrs. Suprun is consistent and open is this position, we have the hope and confidence to see the next steps of the Acting Minister, in particular, regarding the provision of complete public information in response to my inquiries, made in accordance with the requirements of the Law of Ukraine.
Let’s not forget that the verb to minister- in English means "Serving". And any official of the Cabinet of Ministers of Ukraine, including Mrs. U. Suprun, must serve the people of Ukraine, and not act in their favor.
By the way, the scandalous results of the audit logically build a causal chain on dismissal of the head of the Center Mrs. N. Nizova.
And then strange things begin. First, it concerns the silent, hotbed of the release of Mrs. N. Nizova, taking into account the results of the audit. And secondly, the scandalous searches by Vice Prime Minister of the next place of work for the "valuable" worker Mrs. N. Nizova.
As a result of "serving" the Vice prime minister, the chairman of the National Council of Pavlo Rozenko:
Keeping in mind in September 2017 the shocking results of the audit of evidence of corruption, at a meeting of the National Council on October 5, 2017, Pavlo Rozenko personally rejected the proposal of the member of the National Council of Igor Gorbasenko about recognition of the Center's activities unsatisfactory. He still took the fired head of the Center Mrs. N. Nizova to himself as an adviser to the Vice Prime Minister, and still voted for the appointment of its chairman of the artificially created "Politburo", I apologize, the Presidium of the National Council.
WHAT IT IS?
Some hot heads roughly express the idea that he is:
a). Interested in experience, how can you do actions with signs of corruption, and he needs qualified advice on a larger scale?
b). Tried to rehearse her as a neglected person?
Its better also not to believe and share these thoughts, but, in any case, the actions of the head of the National Council look illogical, raise many issues in terms of anti-corruption legislation and the promotion of democratic values.
In connection with the above, I, in accordance with the legislation of Ukraine, sent to the Ministry of Healthcare of Ukraine requests for public information on the providing in writing the materials certified as appropriate:
1. AUDITOR'S REPORT Based on the results of the internal audit of the Public Health Center of the Ministry of Public Health of Ukraine dated September 8, 2017 No. 13-15 / 06.
2. DOCUMENTS of the Ministry of Healthcare of Ukraine on notifications to law enforcement agencies, in particular NATIONAL ANTICORRUPTION BUREAU OF UKRAINE, regarding this offense and signs of corruption.
3. RECOMMENDATIONS of the Office of Audit and Analysis of the Ministry of Health of Ukraine regarding the results of the internal audit of activities State institution "Public Health Center of the Ministry of Healthcare of Ukraine ", according to the order of the Ministry of Health of Ukraine dated July 24, 2017 No. 47-Adm.
4. DOCUMENTS (action plans) on elimination and prevention of corruption deficiencies in the activities of the Center with measures implemented and enforceable.
5. THE ACTIVITY PLAN of the internal audit of the ministry of health of Ukraine for the second half of the year 2017, approved by the securities Minister of Ukraine from June 12, 2017.
6. Order of the Ministry of Health of Ukraine dated 07.24.2017 № 47-Adm on approval of the above-mentioned plan.
On the responses and development of the process, I intend to inform you and other interested parties as a member of the National Council and as a person who continues an independent journalistic investigation.
Because the violations highlighted in the Audit Report relate, among other things, to the Global Fund, the "chicken blind" affects the Commission for overseeing the development of applications, negotiation and implementation of programs undertaken at the expense of the Global Fund to Fight AIDS by Tuberculosis and Malaria in the National Council, and personally its head, Mrs. N. Salabai.
There is also no information on the reaction of the authorized agent of the Global Fund in Ukraine – Price Waterhouse & Cooper.
7. In accordance with the Code of Conduct of the Global Fund Resource Recipients
«3.2.2. Recipients should not participate, directly or indirectly, including through agents or other intermediaries, in corrupt, fraudulent, anti-competitive activities or compulsory practices, or in collusion with Global Fund resources, as defined in Appendix I to this Code».
«3.2.3. In addition, Recipients should not participate in theft, theft, misappropriation or misuse of Global Fund resources, as defined in Annex I to this Code».
«4.1. Recipients and representatives of the recipient shall observe in their countries of business all applicable laws and regulations, including all civil and criminal laws, as well as the published rules, rules and policies of the Global Fund that are relevant to their field of activity».
Unfortunately, the government agencies "Public Health Center of the Ministry of Healthcare of Ukraine ", which is one of the principal recipients of the Global Fund found to have signs of corruption.
Therefore, the default actions and concealment of the above-mentioned acts of corruption by the Global Fund are subject to the Global Fund sanctions provided , in particular , by the Code of Conduct of the Global Fund Resource Recipients.
Taking into account the legislation of the state of Ukraine, the indicated actions of the heads of the National Council, who have the status of civil servants, raises questions about compliance with the Laws of Ukraine "On Prevention of Corruption" and the Law "On Civil Service".
P.S. In terms of consultations with the Coordinating Mechanisms of the countries and their members regarding the discussion of the draft Code of Conduct for members of the CCM, I have to make the following suggestion:
"In the event of the Global Fund's officials failing to respond to activities that have signs of corruption, with the support and implementation of the Global Fund projects in the recipient countries of the GF grants, the members of the ССМ should inform the government bodies of the Global Fund Donors."

Щодо діяльності з ознаками корупції Державної установи «Центр громадського здоров’я Міністерства охорони здоров’я України», який безпосередньо приймає участь у взаємодії із Глобальним фондом
Членам Національної ради, зацікавленим сторонам.
Шановні колеги!
Маю здогадуватись, що більшість із Вас не знайома із подіями кінця 2017 року, які передували засіданню Національної ради протидії туберкульозу і СНІДу в Україні 05 жовтня 2017 року. Я теж тільки нещодавно в процесі незалежного журналістського розслідування отримав інформацію щодо подій, які, звісна річ, у належному обсязі сором’язливо не анонсувалися ані Державною установою «Центр громадського здоров’я Міністерства охорони здоров’я України», ані Міністерством охорони здоров’я України.
Річ іде про діяння з відвертими ознаками корупції на суму більш ніж 10 мільйонів гривень у Центрі, які знайшли своє відображення у матеріалах внутрішнього аудиту діяльності зазначеного центру,
У третьому кварталі 2017 року Міністерством охорони здоров’я був проведений внутрішній аудит діяльності Центру. За результатами аудиту був виконаний АУДИТОРСЬКИЙ ЗВІТ за результатами внутрішнього аудиту Державної установи «Центр громадського здоров’я Міністерства охорони здоров’я України» від 08.09.2017 № 13-15/06.
У даному звіті представлено результати планового внутрішнього аудиту (за напрямами фінансовий аудит та аудит відповідності), проведеного в Державній установі «Центр громадського здоров’я Міністерства охорони здоров’я України», за період діяльності з 01 січня 2016 року по 01 липня 2017 року.
Аудит проведено відповідно до Плану діяльності з внутрішнього аудиту Міністерства охорони здоров’я України на друге півріччя 2017 року, затвердженого в.о. Міністра від 12 червня 2017 року, згідно з наказом Міністерства охорони здоров’я України від 24.07.2017 № 47-Адм та у відповідності до Порядку проведення внутрішнього аудиту в системі Міністерства охорони здоров’я України, затвердженого наказом МОЗ України від 27.03.2012 № 207.
Саме в цьому аудиторському звіті надане визначення діяльності Центру як такого, яке має ознаки корупції.
Треба віддати належне мужньому і чесному вчинку в. о. Міністра щодо публічної і принципової боротьби із корупцією у підрозділах міністерства. Наскільки послідовною і відкритою є ця позиція пані У. Супрун, маємо надію і впевненість переконатися із наступних кроків в. о Міністра, зокрема, щодо надання повної публічної інформації у відповідь на мої запити, зроблені відповідно до вимог Закону України.
Не варто забувати, що to minister– у перекладі із англійської означає «Слугувати». І будь-яка посадова особа Кабінету Міністрів України, в тому числі і У.Супрун, мають слугувати саме народу України, а не діяти у своє уподобання.
До речі, скандальні результати аудиту логічно вибудовують причинно – наслідковий ланцюжок щодо звільнення з посади керівника Центру Н. Нізової.
А далі починається дивні речі. По-перше, це стосується тихого, підкилимового звільнення Н. Нізової, зважаючи на результати аудиту. І по-друге, скандальні пошуки Віце – Прем’єр-міністром чергового місця роботи для «коштовного» працівника Н. Нізової.
Щодо «слугування » профільного Віце-Прем’єр-Міністра, голови Національної ради Павла Розенка:
ЗНАЮЧИ ще у вересні 2017 року про шокуючі РЕЗУЛЬТАТИ АУДИТУ, ЩО МАЮТЬ ОЗНАКИ КОРУПЦІЇ, на засіданні Національної ради 5 жовтня 2017 року, Павло Розенко особисто відхилив пропозицію члена Національної ради Ігоря Горбасенка ПРО визнання діяльності Центру НЕЗАДОВІЛЬНОЮ. Та і ще узяв звільненого керівника центру Н. Нізову до себе у статусі радника Віце-прем’єр-міністра, та й ще голосував за призначення її головою штучно створеного «Політбюро», вибачаюсь, Президії Нацради.
ЩО ЦЕ?
Деякі гарячі голови необачно висловлюють думку, що це:
а). Зацікавленість досвідом, як можна робити діяння з ознаками корупції, І йому потрібні кваліфіковані поради на більш масштабному рівні?
б). Узяв на перевиховання як бездоглядну?
В це також не хочеться вірити і поділяти ці думки, але, в будь-якому разі, дії керівника Нацради виглядають нелогічними, викликають багато питань з точки зору антикорупційного законодавства і просування демократичних цінностей.
У зв’язку із викладеним, мною згідно законодавства України спрямовані до МОЗ України запити на отримання публічної інформації щодо надання у письмовому вигляді завірених відповідним чином матеріалів:
1. АУДИТОРСЬКОГО ЗВІТУ за результатами внутрішнього аудиту Державної установи «Центр громадського здоров’я Міністерства охорони здоров’я України» від 08.09.2017 № 13-15/06.
2. ДОКУМЕНТІВ Міністерства охорони здоров’я України про сповіщення до правоохоронних органів, зокрема НАЦІОНАЛЬНОГО АНТИКОРУПЦІЙНОГО БЮРО УКРАЇНИ, щодо зазначеного правопорушення і ознак корупційних дій.
3. РЕКОМЕНДАЦІЙ Управління аудиту та аналітики МОЗ України за результатами внутрішнього аудиту діяльності Державної установи «Центр громадського здоров’я Міністерства охорони здоров’я України», згідно з наказом МОЗ України від 24.07.2017 № 47-Адм.
4. ДОКУМЕНТІВ (планів заходів) по усуненню і попередженню корупційних недоліків у діяльності Центру із заходами, що виконані і підлягають виконанню.
5. ПЛАНУ ДІЯЛЬНОСТІ з внутрішнього аудиту Міністерства охорони здоров’я України на ІІ півріччя 2017 року, затвердженого в.о. Міністра від 12 червня 2017 року.
6. НАКАЗУ Міністерства охорони здоров’я України від 24.07.2017 № 47-Адм про затвердження вищезазначеного плану.
Про відповіді і розвиток процесу маю наміри інформувати Вас і інші зацікавлені сторони як член Національної ради і як особа, яка продовжує незалежне журналістське розслідування.
Оскільки порушення, що висвітлені у Аудиторському звіті, стосуються, в тому числі, коштів Глобального Фонду, вражає «куряча сліпота» Комісії з нагляду за розробкою заявок, ведення переговорів та реалізації програм, які здійснюються за рахунок коштів Глобального фонду для боротьби зі СНІДом туберкульозом та малярією у складі Національної ради, і особисто її керівника пані Н. Салабай.
Також відсутня будь-яка інформація щодо реакції уповноваженого агента Глобального Фонду в Україні – Прайс Ватерхаус енд Купер.
7. Відповідно до Кодексу поведінки Реципієнтів Ресурсів Глобального фонду
«3.2.2. Реципієнти не повинні брати участі, прямо або побічно, в тому числі через агентів або інших уповноважених осіб, в корупційній, шахрайської, що перешкоджає конкуренції діяльності або примусової практиці або в практиці змови щодо Ресурсів Глобального фонду, як вони визначаються в Додатку I до цього Кодексу».
«3.2.3. Крім того, реципієнти не повинні брати участі в розкраданні, крадіжці, неправомірному присвоєнні або нецільовому використанні ресурсів Глобального фонду, як вони визначаються в Додатку I до цього Кодексу».
«4.1. Реципієнти і Представники реципієнта дотримуються в країнах, в яких вони ведуть справи, всіх діючих законів і правил, включаючи всі цивільні і кримінальні закони, а також оприлюднені норми, правила і політику Глобального фонду, що належать до сфери їх діяльності».
Нажаль, діяльність Державної установи «Центр громадського здоров’я Міністерства охорони здоров’я України», що є одним із основних реципієнтів Глобального фонду, визнана такою, що має ознаки корупції.
Тому дії по замовчуванню і приховуванню від Глобального фонду зазначених діянь з ознаками корупції підпадають під дії санкцій Глобального Фонду, передбачених, зокрема, Кодексом поведінки Реципієнтів Ресурсів Глобального фонду.
З огляду на законодавство держави Україна, зазначені дії керівництва Національної ради, які мають статус державних службовців, викликають питання щодо відповідності Законам України «Про запобігання корупції» та Закону «Про державну службу».
Р.S. В плані консультацій Глобального Фонду із Координаційними механізмами країн та їх членами щодо обговорення проекту Кодексу поведінки для членів КМК, маю надати наступну пропозицію:
«У разі неприйняття посадовими особами Глобального Фонду заходів реагування на діяльність, що має ознаки корупції, при супроводі і виконанні проектів Глобального Фонду у країнах-отримувачах грантів ГФ, члени ССМ мають повноваження інформувати державні органи країн – донорів Глобального Фонду».
